By accessing the website at https://ilukaroad.com.au/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

1. Permission is granted to temporarily download one copy of the materials (information or software) on Iluka Road’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on Iluka Road’s website;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or “mirror” the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Iluka Road at any time. Iluka Road makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, Iluka Road does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Iluka Road or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Iluka Road’s website, even if Iluka Road or a Iluka Road authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on Iluka Road’s website could include technical, typographical, or photographic errors. Iluka Road does not warrant that any of the materials on its website are accurate, complete or current. Iluka Road may make changes to the materials contained on its website at any time without notice. However Iluka Road does not make any commitment to update the materials.

Iluka Road has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Iluka Road of the site. Use of any such linked website is at the user’s own risk.

7. Modifications

Iluka Road may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

ORDERS AND DISPATCH

Orders can be placed via our website or via email to sales@ilukaroad.com.au If items are in stock we will endeavour to dispatch your order within 2 business days. Metro Brisbane can expect to receive stock within 2-3 business days. Metro Sydney and Metro Melbourne can expect goods within 7 business days and Metro Perth and other parts of Australia can expect within 14 business days.

FREIGHT

Iluka Road Collection can arrange freight; however, freight costs are the responsibility of the purchaser and will appear on your invoice when applicable. Freight is charged pro-rata. As a service to our clients, we endeavour to keep freight rates at a reasonable and fair price. We cannot guarantee that we can provide freight to all non-Metro areas of Australia, in this case the freight will be the responsibility of the customer and any damages to goods are the responsibility of the purchaser. We recommend that when customers organise their own freight to use furniture carriers rather than couriers.

BACKORDERS

Goods not in stock are backordered. This will be shown on your invoice and will not be charged. Backorders will be filled when stock becomes available. Payment will be required prior to dispatch. Freight is charged on backorders.

CANCELLATIONS

Cancellations will not be processed unless received in writing.

Any orders that are cancelled once packed and ready for delivery will incur a 5% re-stocking and admin fee. 

REFUNDS AND RETURN POLICY

For the purpose of this clause: 

2010. “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010. 
2011. To the full extent permitted by law, and subject to the remainder of this clause, the parties agree that neither party to this agreement shall have any liability, obligation or responsibility, whether in contract, tort (including but not limited to negligence), under statute or on any other basis, for any indirect, incidental, consequential, special or exemplary damages, or damages for loss of profits, revenue, data or use, arising in any way in connection with this agreement including, but not limited to, damage to property, injury to persons, lost profits, or delays or inconvenience, even if such party has been advised of the possibility of such damages. 

To the full extent permitted by applicable law, our maximum aggregate liability in respect of all Claims shall not exceed $20,000,000. 

Where you obtain goods or services from us as a consumer, within the meaning of the Australian Consumer Law: 

1. Such goods or services are supplied subject to the guarantees set out in Division 1 of Australian Consumer Law (“the Guarantees”), subject to ii and iii; 
2. In the case of goods, our liability for failure to comply with a Guarantee (other than a Guarantee under section 51, 52 or 53 of the Australian Consumer Law) is limited to the replacement of the goods or the supply of equivalent goods;  

iii. In the case of services, any liability for failure to comply with a Guarantee is limited to the supply of the services again; and 

1. This clause prevails over all other provisions of this agreement. 

Notwithstanding the foregoing, if we receive a written request that complies with the PDF format available on our website and if such request is received within 7 days of your receipt of the relevant goods, then we may at our absolute discretion authorise returns of goods or credits in respect of goods. 

Returns and Credits are only accepted if authorised by Iluka Road Collection, and are received in writing by our customer service team. Credit claims will only be accepted if notification is made within 7 days of receipt unless otherwise stated in these Terms and Conditions. Goods may only be returned by a carrier approved by Iluka Road Collection. A handling charge may apply on returned goods.  Returns and Credits will only be processed once approved by our team in writing. Iluka Road Collection will not be responsible for damage caused in transit where a customer has used their own carrier.

Goods are checked before they leave our warehouse. All items must be opened and checked within 24 hours of the customer receiving the goods, otherwise, we cannot be liable for damage incurred during transit. You will be required to take a photo of the damage as proof prior to the claim being assessed. 

In the unlikely event that your item arrives damaged or faulty, our team will work to provide the best resolution. You will be offered a replacement item if available. If a replacement item is not available you will be offered a full refund. A refund is not available if a replacement item is available.

Goods damaged by you, natural wear and tear and Buyer’s Remorse:

We will not accept the return of goods that are damaged by you (accidentally or otherwise) or due to natural wear and tear following delivery. Once goods have been dispatched from our warehouse you will not be entitled to refuse delivery of goods nor request a return, refund or exchange of goods you have purchased on the basis that you have changed your mind about the purchase of the goods.

We will not accept the return of goods that are damaged by you (accidentally or otherwise) or damaged due to fair wear and tear following delivery. Once goods have been dispatched from our warehouse, you agree not to refuse delivery of goods nor request a return, refund or exchange of goods that you have purchased on the basis that you have changed your mind in respect of the purchase of the goods. 

PAYMENT

All orders must be paid for prior to dispatch unless a prior agreement is in place.  We accept direct bank transfer deposit and credit card (Amex, MasterCard and Visa only). Credit card charges apply to customer payments made via credit card – 1% for Mastercard and Visa and 3% for Amex.

For approved trade 30 day account holders, your account status will remain active, however please note the following:  Our terms are strictly 30 days from date of invoice. Overdue accounts will incur an interest charge of 2.5% calculated for the period the account is due until the date it is paid. Please note any accounts referred to our collection agency will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.  Any accounts with a history of late payments will be reverted back to a pro forma basis. You will remain on pro forma at the discretion of our accounts department.

All wholesale prices quoted are subject to GST.
